Knows Beers – Terms of Service

1. Acceptance of Terms

By accessing or purchasing from knowsbeers.club ("we", "us", "our", "Knows Beers"), you agree to these Terms of Service. If you don't agree, please don't use the site.

2. Who We Are

Knows Beers is an Australian business selling apparel and merchandise. Products are manufactured on a print-on-demand basis.

3. Eligibility

You must be 18+ or have parent/guardian consent to purchase. By ordering, you confirm the information you provide (name, address, payment details) is accurate.

4. Products & Production

All products are made to order. Colours, print placement, and garment specifics may vary slightly from photos due to the nature of print-on-demand manufacturing, screen display settings, and batch variation. This is not considered a fault.
We reserve the right to discontinue, modify, or limit stock/designs at any time without notice.
Product images are illustrative. Sizing charts are provided for each product — you're responsible for selecting the correct size.

5. Pricing & Payment

All prices are in AUD and include GST where applicable. Shipping is charged separately at checkout.
We reserve the right to change prices at any time without notice; the price charged is the price displayed at the time you complete checkout.
Payment must be received in full before production begins. We use third-party payment processors (e.g. Shopify Payments) and do not store your card details.
We reserve the right to refuse or cancel any order at our discretion (e.g. suspected fraud, pricing errors, stock issues), in which case any payment taken will be refunded in full.

6. Shipping & Delivery

Production and delivery timeframes shown on the site are estimates only and not guaranteed.
Risk in the goods (loss, damage, delay) passes to the courier once dispatched; we are not liable for delays or issues caused by the carrier once an order has been shipped, though we'll reasonably assist you in resolving carrier issues where we can.
We are not liable for delivery delays caused by incorrect address details provided by you, customs, or events outside our reasonable control (see Section 11).

7. Refunds, Returns & Faulty Goods

Refunds, returns, and faulty/damaged item claims are handled under our Refund & Returns Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Intellectual Property

All designs, artwork, logos, text, and content on this site are owned by Knows Beers (or used under licence) and protected by copyright and trade mark law.
You may not reproduce, resell, or use our designs or content commercially without our prior written consent.
Purchasing a product gives you no rights to the underlying design beyond personal use of the physical item.

9. User Conduct

You agree not to use the site to:

Engage in fraudulent, unlawful, or harmful conduct
Attempt to interfere with the site's operation or security
Infringe our or any third party's intellectual property rights

We may suspend or refuse service to anyone who breaches these Terms.

10. Limitation of Liability

To the maximum extent permitted by law:

Our liability for any claim arising from your use of the site or purchase of products is limited, at our option, to the resupply of the goods/services or the cost of resupply.
We are not liable for any indirect, consequential, or special loss (including loss of profits, data, or opportunity) arising from your use of our site or products.
Nothing in this section excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

11. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including supplier/fulfilment delays, natural disasters, courier disruptions, or system outages.

12. Third-Party Links & Services

Our site may link to or rely on third-party services (payment processors, fulfilment partners, analytics). We are not responsible for the content, policies, or performance of those third parties.

13. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or damage arising from your misuse of the site, breach of these Terms, or violation of any law or third-party right.
